Terms and Conditions
We want your order to be processed as smoothly and quickly as possible and want to declare all terms openly to you. If you are unsure about anything, please contact us so that we can assist you with your order.
By placing an order and formulating requests for products and services from Campbell Watson, you unconditionally agree to the following Terms and Conditions. Please read them carefully.
1. ORDERING
1.1 Shopping with Campbell Watson is a fast and secure process. Once you have made your selection and proceeded to Checkout your credit card or debit card details will be required, together with confirmation of the delivery address. Campbell Watson currently accepts Visa, MasterCard, Switch/Maestro, Delta and Solo cards for online orders. Once payment has been received, the order process will begin.
1.2 Once you have successfully placed an order you will be sent an email confirming receipt and the details of your order. Your order represents an offer by you to purchase goods from us. Please note, it is the customer's responsibility to check the confirmatory email and notify us immediately of any errors to info@campbellwatson.co.uk. We may call or email to arrange a delivery date once the order is ready to be dispatched, or to inform you that goods have been dispatched.
1.3 A Customer must provide true, accurate, current and complete personal information when ordering, and should not impersonate another person or entity, or use any false name or any name that the Customer is not authorised to use. By placing an order, you confirm that the credit or debit card that is being used is your own, or is being used with full authorization of the cardholder. All card holders will be subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment to us, we will not be able to process your order, nor will we be liable for any delay or non-delivery of product(s) as a result.
1.4 Special offers are subject to change, and only one offer can be used per customer order, unless specifically agreed by Campbell Watson.
2. PRODUCT INFORMATION
2.1 All prices are quoted in British pounds sterling and are inclusive of UK Value Added Tax but exclude delivery charges. If the price quoted on the website is incorrect and the correct price is lower than that quoted we will charge you the lower price. If the correct cost is higher than the quoted price we will either advise you of the true cost and await your confirmation of your order at the higher price or inform you that we cannot accept your order and explain the circumstances surrounding such cancellations.
2.2 We reserve the right to make price adjustments if it is discovered that the price is incorrect or to protect us from price rises for reasons such as a supplier's price increase, new taxes and currency fluctuations. A purchase contract is not formed until the price has been checked by Campbell Watson. If a price adjustment is required, we will notify you before arranging delivery.
2.3 We make every effort to ensure colours appear as realistic as possible. However, due to the constraints of digital reproduction on different web browsers, we cannot guarantee exact colour depiction. Please be aware that the actual colour you see on the screen may differ to those of your ordered products. Every care is taken to ensure descriptions and measurements are accurate, however slight variations or errors may occur. Packaging may vary from that shown.
2.4 For all items made from natural products, such as leather or wood, it is not possible to guarantee items will have the same colour, shade, pattern or finish as items viewed in the showroom or on the website, due to the inherent nature of such products. Also, we cannot guarantee to match goods exactly that have been ordered at different times.
2.5 Please note on all light fittings supplied, where lamps (lightbulbs) are included or ordered these are not covered by any guarantee and do not have a specified or guaranteed lifespan.
2.6 Please note that some products may require assembly. For more information about our assembly service, please call 0121 7114675.
2.7 Products made from recyclable plastic can be recycled where facilities exist.
2.8 For all lighting products it is essential that you use the recommended light bulbs. Failure to do so may result in damage to the light and may affect your warranty.
3. REFUNDS AND RETURNS
All goods are quality checked before they are dispatched but if the product is found to be faulty, please contact us within 2 days of delivery.
3.1 FURNITURE ORDERS
3.1.1 Please note that we will not be able to change the order, provide a refund, or exchange any item that has been entered into production as per the customer's specification in a specific finish or upholstery choice.
3.1.2 Only order if you are sure that the item and finish is right for your needs as you will not be able to change the order after the item has been entered into production. Also be careful to check access to your property as delivery is on the basis that you have checked the dimensions of the item and that it fits through all doorways, stairwells and within the area of intended use.
3.1.3 Campbell Watson has no liability for items ordered that a Customer no longer requires. Once an order has been processed the Customer is liable to purchase the items.
3.1.4 Should an item be received defective then a replacement will be manufactured and a replacement will be delivered as soon as possible based on the following procedure:
- Inspect your purchases immediately upon receipt as no claim for replacement can be made after 2 days.
- Any claim regarding defective items must be made initially by telephone or email, followed by a written claim.
- In all cases the product(s) must be adequately packed and returned in the original packaging to prevent damage.
3.2 STANDARD ITEMS - Faulty
3.2.1 Please contact us immediately (within 2 days of package arrival) by calling 0121 7114675 or at info@campbellwatson.co.uk to discuss our procedures as detailed below and to organise a replacement.
- Inspect your purchases immediately upon receipt as no claim for replacement can be made after 2 days.
- Any claim regarding damaged or defective items must be made initially by telephone or email, followed by a written claim.
- In all cases the product(s) must be adequately packed in the original packaging to prevent damage.
3.3 STANDARD ITEMS – Returns that are Not Faulty
Please contact us within 48 hours of receiving your order to discuss a return or exchange in line with the procedure below:
- A written notice of your cancellation is required and the goods must be returned in perfect condition and in all of its original packaging (in a resaleable condition) within 7 days of receipt of the goods along with your order reference number.
- Where items are large or fragile (as determined by Campbell Watson) we reserve the right to nominate a specialist furniture handler for return transit and pass the cost of delivery onto the Customer. This transportation charge will be charged each time the Customer accepts a returns collection date but then subsequently fails to meet.
- The cost of returning the product(s) will be the responsibility of the Customer who must insure the transit of the goods.
- As soon as we receive the returned goods in a resaleable condition we will refund the cost of the goods (minus any delivery charges - if applicable). We will provide the refund within 30 days from the receipt of the goods.
- If your order was delivered free of charge, we will deduct delivery costs, incurred by us, from your refund.
If you do not contact us within 2 days of receiving the goods, we reserve the right to issue a credit note, instead of a refund. Refunds/exchanges can only be given where the goods are in brand new condition and if they have not been installed.
4. LIABILITY
4.1 Campbell Watson will not be liable for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable by either party when the contract for sale was formed.
4.2 If the goods are not what you ordered, are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability unless you notify us of the problem within 2 days of the delivery of the goods in question.
4.3 We shall not be liable for any defects in the goods caused by any act, neglect or default by you or any third party.
4.4 We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question (minus any delivery charge).
4.5 Nothing in this Agreement shall limit Campbell Watson's liability for death or personal injury caused by our negligence or breach of duty.
4.6 We reserve the right at any time, in whole or any part thereof, to modify or withdraw, temporarily or permanently, the products and services offered through and via this website. Whilst fulfilling all obligations on the part of Campbell Watson, concerning prior received offers to purchase a product, you confirm that Campbell Watson shall not be liable to you or any third party from such modification or withdrawal of services. Your continued use of the website or confirmation of acceptance of an amended order following such change shall be deemed to be your acceptance of such change.
5. GOVERNING LAW
These terms and conditions are governed by English law, you agree to submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising under or in connection with these terms and conditions or the contract between us. These terms and conditions do not affect your statutory rights.
